Terms of Service

1. Acceptance of terms
By creating a BizEnzo account or otherwise accessing the BizEnzo platform (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which are incorporated herein by reference. If you are accepting on behalf of a business, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Service.
2. Description of the Service
BizEnzo provides a multi-tenant SaaS platform that enables local businesses to manage online bookings, customer relationships, invoicing (including HST), staff scheduling, and marketing automation. Features available to your account depend on the subscription plan selected. BizEnzo reserves the right to modify, suspend, or discontinue features with reasonable notice.
3. Accounts and eligibility
You must be at least 18 years of age and capable of forming a legally binding contract to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorised use of your account at support@bizenzo.com.
4. Free trial and subscriptions
New accounts receive a 30-day free trial with access to all features on the Growth plan. No credit card is required to start a trial. At the end of the trial period, continued use requires a paid subscription. Subscription fees are billed monthly or annually in Canadian dollars (CAD) and are non-refundable except as required by applicable law. BizEnzo reserves the right to change pricing with 30 days' notice; price changes will not affect your current billing period.
5. Acceptable use
You agree not to use the Service to: violate any applicable law or regulation; infringe on the intellectual property rights of others; send unsolicited commercial electronic messages without proper CASL consent; harvest or scrape data from the platform; attempt to gain unauthorised access to other tenants' data; or engage in any conduct that disrupts or damages the Service or its infrastructure. Violation of this section may result in immediate account suspension or termination.
6. Intellectual property
BizEnzo and its licensors retain all right, title, and interest in the Service, including all software, branding, and documentation. You retain ownership of any content or data you upload to BizEnzo (“Customer Data”). You grant BizEnzo a limited licence to process Customer Data solely to provide and improve the Service. BizEnzo may use anonymised, aggregated data for analytics and product development.
7. Confidentiality and data security
BizEnzo will implement and maintain reasonable technical and organisational measures to protect Customer Data against unauthorised access, disclosure, or loss. BizEnzo will notify you without undue delay in the event of a confirmed data breach affecting your Customer Data. Details of our security practices are available on our Security page.
8. Third-party services
The Service integrates with third-party providers including Stripe, Twilio, Google, and others. Your use of those integrations is subject to those providers' own terms and privacy policies. BizEnzo is not responsible for the availability, accuracy, or conduct of third-party services.
9. Limitation of liability
To the maximum extent permitted by applicable law, BizEnzo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including loss of revenue, data, or goodwill. BizEnzo's total aggregate liability to you for any claim shall not exceed the fees you paid to BizEnzo in the 12 months preceding the event giving rise to the claim.
10. Termination
Either party may terminate these Terms at any time. You may cancel your subscription from the Billing settings page in your dashboard; cancellation takes effect at the end of the current billing period. BizEnzo may suspend or terminate your account immediately if you breach these Terms or if required by law. Upon termination, your Customer Data will be available for export for 30 days, after which it will be deleted in accordance with our data retention policy.
11. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Toronto, Ontario under the ADRIC Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or a prominent notice in the dashboard at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
